IN CONSIDERATION of being permitted to observe, work, or participate in any way in the EVENT(S) (defined as any event or program sponsored by or affiliated with Blue Mustang Registry Scenic Stampede for him/herself, vehicle occupants, personal representatives, heirs, and next of kin agree and acknowledge all terms and conditions contained herein. All entry fee payments are final and non-refundable.
Any driver, passenger or participant in the Stampede is defined as a “Participant” and referenced throughout the terms and conditions. A driver is defined as anyone operating a vehicle in the Stampede regardless of position in vehicle.
The Blue Mustang Registry Scenic Stampede (the “Stampede”) IS NOT A RACE. You must NOT compete in any manner with other participants. You must NOT place bets of any kind in relation to the Stampede. You must drive safely and with proper courtesy to all other participants and public. You must NOT drive if your ability to do so safely and properly is impaired by illness, lack of rest, medical intoxication or under the influence of illegal substances, or any other condition that will put you or other participants, general driving public, pedestrians, and any other person or property at risk. There is no reckless driving allowed, cutting off of other cars, driving on shoulders or endangering other participants or the public.
You MUST comply with all applicable laws and regulations of the City, County, State and Country in which you are present including but not limited to speed regulations, laws of the road, safety or your vehicle and operation of vehicle, and laws relating to personal license and insurance. The Blue Mustang Registry staff reserves the right to prohibit anyone from participating for any single violation of the foregoing or any terms and contained contained herein.
Each driver shall obtain and maintain appropriate insurance coverage and shall provide proof of such insurance in a form satisfactory to Blue Mustang Registry staff should they request such documentation. Appropriate insurance includes, without limitation, third party liability, liability covering each participant, medical insurance, damage to property and life insurance, and insurance covering participant vehicle’s in the Stampede.
Each driver must hold a current, valid, unrestricted driver’s license that is valid in the United States and must present same upon request.
HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the promoters, participants, sponsors, sanctioning organizations or any subdivision thereof, vehicle owners, advertisers, owners and lessees of premises used to conduct the EVENT(S), underwriters, consultants and others who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or EVENT(S) and each of them, their directors, officers, agents and employees, all for the purposes herein referred to as “Releasees,” FROM ALL LIABILITY , his personal representatives, vehicle occupants, assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT(S), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releasees and each of them FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or related to the Participant’s INJURY OR DEATH, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of or related to the EVENT(S) whether caused by the NEGLIGENCE OF RELEASEES or otherwise including but not limited to third party action or lawsuits as a result of Particpant’s actions, omissions or participating in the Stampede, including but not limited to Participants violation of any Federal, State, County or City Laws, ordinances or regulations, or Participants breach of any terms and conditions contained herein.
HEREBY acknowledges that THE ACTIVITIES OF THE EVENT(S) ARE DANGEROUS and involve the risk of serious injury and/or death and/or property damage.
HEREBY agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releasees, and is intended to be as broad and inclusive as is permitted by the laws of the State or Province in which the Event(s) is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
HEREBY acknowledges that he has informed any and all vehicle occupants that THE ACTIVITIES OF THE EVENT(S) ARE DANGEROUS and involve the risk of serious injury and/or death and/or property damage.
The Blue Mustang Registry staff is not responsible if it is unable to fulfill its obligations due to fire, earthquake, epidemic/pandemic diseases, flood, cyclone, aridity, strike, lightning, revolution, terroist activities or similar troubles, and in other cases generally accepted as Force Majeure under the statutes and case law of the State of Georgia.
The Blue Mustang Registry staff reserves the right to refuse participation in or to cancel the Stampede at any time for any reason whatsoever.
By participating in the Stampede, Participant consents to be photographed and to be included in the filming of footage documenting the Stampede. Participant hereby wives any rights of publicity or privacy and grants the Blue Mustang Registry staff full and complete permission to utilize and exploit Participant’s appearance in the Stampede in and and all manner and media throughout the world in perpetuity. Blue Mustang Registry staff also reserves the right to refuse, use or edit any photographs or footage in which Participant appears. Participant consents to the use of name, image, likeness, voice and biographical material in connection with any and all footage. Participant expressly releases the Blue Mustang Registry staff from and against any and all claims which Participants has or may have for invasion of privacy, defamation or any other cause of action arising out of the production, distribution, broadcast, or exhibition of photographs, footage or any promotional materials.
The Blue Mustang Registry staff reserves the right to change these terms and conditions from time to time without notice. Participants shall be deemed to have accepted these terms by participating in the Stampede.
IN CONSIDERATION FOR BEING PERMITTED TO PARTICIPATE IN THE STAMPEDE PARTICIPANT AGREES TO WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
